These terms govern your use of the Mon logement idéal platform. By creating an account or using the service, you accept them. They are written in plain language; if anything is unclear, contact us.
1. Purpose and acceptance
Mon logement idéal connects people looking for housing with landlords, property managers and tenants transferring a lease in Quebec. We are not a landlord, a real estate broker, or a party to any lease.
Using the service means you accept these terms and the Privacy Policy. If you do not accept them, do not use the platform.
2. Definitions
- “Platform”: the Mon logement idéal website, pages, features and communications.
- “Seeker”: a person looking for housing who completes a compatibility profile.
- “Landlord”: an owner, manager or authorized representative who publishes a listing.
- “Lease transfer”: a tenant transferring an ongoing lease.
- “Affiliate”: a person enrolled in the referral program.
- “User content”: any text, photo, document or review you submit.
3. Eligibility and account
You must have the legal capacity to enter into a contract to create an account. Accounts are personal: you are responsible for keeping your credentials confidential and for activity carried out from your account.
Information you provide must be accurate and kept up to date. We may refuse, suspend or close an account in case of false information, fraud or breach of these terms.
4. Roles and responsibilities
- Seeker: provide accurate information about your household, budget and criteria; attend booked visits or cancel in advance; never submit documents belonging to someone else.
- Landlord: hold the right to rent or show the advertised unit; describe it accurately; comply with applicable laws, including housing and non-discrimination rules; respond to requests in good faith.
- Lease transfer: hold an ongoing lease, state the real transfer conditions and respect lease and legal obligations.
- Affiliate: promote the platform without misleading practices, spam or brand impersonation.
5. Listing accuracy
Listings must describe a genuinely available unit, at the price actually asked, with photos representative of the unit offered. Fictitious, bait, duplicate or misleadingly priced listings are prohibited.
We may correct, unpublish or refuse a non-compliant listing, without becoming responsible for content published by users.
6. Prohibited content and conduct
- Discrimination based on a ground protected by the Charter of human rights and freedoms.
- Harassment, threats, hateful speech, invasion of another person's privacy.
- False statements, impersonation, forged documents, fake reviews.
- Mass automated scraping, circumvention of technical measures, security attacks.
- Off-platform payment requests presented as official platform fees.
- Publishing third-party personal information without the right to do so.
7. Verification
Some features rely on voluntary verifications: identity, phone number, address, tenant or landlord status, tenant file. A verification only confirms the specific element checked, at the time it was checked.
A verification badge is not an endorsement and not a guarantee of solvency, quality or future behaviour.
8. Matching and artificial intelligence
Compatibility scores, trade-off explanations and suggestions are produced by automated processing based on the information you provide and listing data. They are informational recommendations, not guarantees.
A high score does not guarantee availability, acceptance of your application, or the condition of the unit. Always verify for yourself before committing.
9. Visit booking
Visit booking is a coordination tool. The landlord remains responsible for actual availability, access and holding the visit. We do not guarantee attendance.
Cancel as early as possible if you cannot attend. Repeated no-shows may result in restricted access to this feature.
10. Communications, email and SMS
We send service messages (account confirmation, visit reminders, receipts, alerts you requested). These are necessary to deliver the service you asked for.
Promotional messages are optional and rely on separate consent, which you may withdraw at any time through the unsubscribe link, by replying STOP to SMS, or from your preferences.
11. Payments, plans and refunds
Publishing a listing is free. Some paid features exist, in particular purchasing consultations or plans to unlock qualified requests, and lease-transfer publication fees where configured.
Before any purchase, the platform displays the service description, total price, applicable taxes, billing frequency and, where applicable, automatic renewal. A retainable, printable confirmation is provided after purchase and remains available in your account area.
Auto-renewing plans can be cancelled at any time from your account area; cancellation takes effect at the end of the paid period. Consultations already used are not refundable. Mandatory rights under consumer protection law remain fully applicable.
Payment processing is handled by an external provider. We do not store card numbers.
12. Landlord and building reviews
Reviews must be factual, first-hand and reflect an experience actually lived by the author as a current tenant, former tenant or applicant. Reviewer status and verification level are two separate dimensions displayed separately.
Landlord or manager reputation is separate from building reputation: a review is attached to the corresponding management period so a new manager is not blamed for a predecessor's failures.
A review may be published anonymously to the public while remaining linked internally to an identifiable account for verification and fraud prevention. We do not disclose a reviewer's identity merely because a review is published.
Reviews express the opinions and allegations of their authors. The platform does not guarantee that these allegations are accurate and clearly distinguishes user content from platform-verified attributes.
13. Private evidence, moderation, right of reply and appeal
- Evidence you submit (lease, photos, emails) is private: it supports verification and moderation and is not published automatically.
- Duplicate and fraud controls apply: the same review cannot be published multiple times for the same period.
- Any user can report a review, a reply or a listing.
- The landlord or manager concerned has a public right of reply, which is also moderated.
- A moderation decision may be appealed in writing.
- Moderation actions are recorded in an internal audit history.
14. Intellectual property and licence to your content
The platform, its brand, its matching engine and its interface belong to us. You keep your rights in your content.
By publishing content, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, technically adapt and distribute it as part of the service, for as long as needed for that purpose. You warrant that you hold the necessary rights.
15. Third-party services
The platform relies on providers (hosting, authentication, payments, email and SMS delivery, mapping, analytics). Their use may be subject to their own terms. We are not responsible for third-party sites linked from the platform.
16. Platform availability
We aim for continuous service without guaranteeing uninterrupted availability. Interruptions may occur for maintenance, updates or external causes. We may modify or remove features.
17. Suspension and termination
You may close your account at any time. We may suspend or close an account in case of serious breach, fraud, security risk or legal obligation, with notice where possible.
Closing an account does not erase obligations already incurred, nor records we must keep (billing, proof of consent, moderation history).
18. Disclaimers
The service is provided “as is”. We do not guarantee that you will find housing or a tenant, nor the accuracy of user-published content, subject to mandatory legal warranties.
19. Limitation of liability
To the extent permitted by law, our liability is limited to direct damages and does not exceed the amount you paid us in the twelve months preceding the event.
This limitation does not apply where the law prohibits it, in particular to mandatory consumer rights and to gross or intentional fault.
20. Indemnity
To the extent permitted by law, you indemnify us against third-party claims arising from your content or your breach of these terms. This clause does not apply where the law prohibits it.
21. Governing law and jurisdiction
These terms are governed by the law applicable in Quebec. The courts of the judicial district of Montreal have jurisdiction, subject to mandatory rules allowing a consumer to bring an action before the court of their domicile.
22. Changes
We may amend these terms. The version in force, its date and a summary of changes are published on this page. When a change is significant, we ask you to accept again before continuing.
